Evidence in case against man accused of voyeurism in Steamboat Jimmy John’s bathroom has ‘flaws’

The evidence in a case against a Craig man accused of taking photos of women in a Steamboat Springs Jimmy John’s bathroom has “flaws,” according to Public Defender Shannel Daniels.

Dustin Hyatt, 47, was arrested March 20 and charged with 26 counts of invasion of privacy for sexual gratification and 25 counts of criminal attempt, according to the affidavit for arrest.

According to a news release from the All Crimes Enforcement Team — a task force comprised of officers from the Routt and Moffat county sheriff’s offices, the Steamboat, Craig and Hayden police departments, and the 14th Judicial District Attorney’s Office — officers “uncovered” that Hyatt was in possession of “voyeuristic” photos.



According to the arrest affidavit, the photos were obtained by law enforcement after Hyatt was arrested Feb. 20 for allegedly violating a protection order.

The photos were of various people in a bathroom, all of whom “appear” to be adults and are “largely unidentifiable,” states the news release. After further investigation, the bathroom was identified as the Jimmy John’s bathroom in Steamboat Springs.



During an April 8 hearing at the Routt County Combined Courts, a protection order was issued against Hyatt, barring him from the restaurant.

On June 24, Hyatt failed to appear for a status conference at the courts, but no arrest warrant was issued due to “some confusion,” said Daniels.

During the rescheduled status conference on Wednesday, Daniels told Routt County Judge Erin Wilson that Hyatt’s attorneys and the 14th Judicial District Attorney’s Office are working on a global resolution for his numerous cases, which span across Routt and Moffat counties.

A global resolution would settle the charges against Hyatt in his 11 pending cases in the two counties.

Daniels stated that she has been discussing the “flaws” in the evidence with the district attorney’s office, and the cases are not yet ready for a plea entry.

Wilson concluded the status conference by noting that the cases are “getting old” and urged Daniels to make decisions in Hyatt’s pending cases.

Hyatt’s next Routt County court appearance in this case is scheduled for Aug. 13.
