Three people arrested following Hayden shelter-in-place

Hayden police arrested three people Friday following a shelter-in-place order for the area of 2nd Street and Jackson Avenue, according to a news release from the Hayden Police Department.

Michael Grubbs, 29, is charged with second-degree burglary as a Class 5 felony, unauthorized absence and resisting arrest, according to the news release.

Julie Verma, 58, is charged with accessory to a crime, harboring a fugitive as a Class 5 felony, resisting arrest and obstructing a peace officer.



Billy Zehner, 34, is charged with obstructing a peace officer.

Around 7:50 p.m. Friday, Hayden Police Chief Scott Scurlock met with a Routt County sheriff’s deputy at the Maverik Gas Station in Hayden after two people told law enforcement that Grubbs was at their residence on West Jackson Avenue “entertaining guests,” states an arrest affidavit.



Scurlock confirmed that Grubbs had “active warrants” for his arrest and went to the residence, states the document.

Law enforcement officers spoke with Verma at the front door, who allegedly said that Grubbs was not inside the home, according to the affidavit. Verma then allowed a sheriff’s deputy into the home, where he found Grubbs and told him to exit the residence.

After Grubbs allegedly “did not respond,” Scurlock applied for a search warrant for the residence, the document states. Following the search warrant’s approval, the Northwest Colorado SWAT Team went to the home.

The shelter-in-place order was issued just after 7:30 p.m. Friday as Hayden police, Routt County sheriff’s deputies and Colorado Parks and Wildlife officers executed the search warrant.

The Northwest Colorado SWAT Team — comprised of law enforcement officers from the Hayden Police Department, Routt County Sheriff’s Office, Steamboat Springs Police Department, Craig Police Department and Moffat County Sheriff’s Office — also assisted in the search.

Scurlock began using a PA system on his patrol car around 6:35 p.m., announcing the warrant for Grubbs’ arrest, according to an arrest affidavit.

Scurlock announced that Grubbs and any other occupants in the residence needed to leave the home.

“I would say that anyone else that was inside of (the residence) was in a dangerous situation and I encouraged them to leave the house,” Scurlock wrote in the affidavit. “I said that they could come to the door with their hands empty and law enforcement would escort them out of the danger situation. No one came out of the house.”

Scurlock later announced over the PA system “multiple times” that anyone refusing to exit the home would “be obstructing (law enforcement’s) ability to execute the search warrant,” the affidavit states.

After no one came out of the home, Scurlock advised that law enforcement officers would enter the home and arrest anyone inside. He also announced that officers would break down the door and shoot tear gas into the residence.

An armored SWAT vehicle then broke down the front door, and law enforcement shot tear gas into the home.

Grubbs, Verma and Zehner were arrested after the tear gas was deployed, according to the document.

“No injuries to officers, bystanders or suspects were reported during this operation,” states the news release from the Hayden Police Department. “The scene was secured and cleared safely.”

Following the arrests, the shelter-in-place order was lifted around 10 p.m.
