Preferred Legal Description: The headgates are located at points in the seepage area tributary to the Yampa River, from which it derives its supply of water, the first being Station 0 on the Ditch Plat and Statement of the Easterly Seepage Ditch recorded at File Number 21258 in the Division Engineer’s Office, Water Division 6, such station 0 being located at whence Southeast Corner of Section 15, Township 2 North, Range 85 West of the 6th P.M. bears West 792 feet. The second is Station 9 as shown on such Ditch Plat and Statement of the Easterly Seepage Ditch. Said ditch from Station 0 to Station 9 acts as a drainage and gaining ditch and continues to accumulate wastewaters and seepage to Station 9, whence it is conveyed through the remaining portion of said ditch for the purposes and uses claimed. Source: Numerous springs, return flows and wastewater, including seepage and surface flow from lands uphill and upstream of the Easterly Seepage Ditch including land along the ditch as described on the Ditch Plat and Statement of the Easterly Seepage Ditch recorded at File Number 21258 in the Division Engineer’s Office, Water Division 6. Date of initiation of appropriation: 1895. How appropriation was initiated: Application of ditch irrigation purposes, see affidavit dated May 10, 1956, attached hereto as Exhibit A. Date water applied to beneficial use:1895. Amount claimed in cubic feet per second (cfs) or gallons per minute. 1cfs = 448.8 gpm: 4.8 c.f.s. Absolute. You are hereby notified that you will have until the last day of FEBRUARY, 2011 to file with the Water Court a Verified Statement of Opposition, setting forth facts as to why a certain Application should not be granted or why it should be granted only in part or on certain conditions. A copy of such Statement of Opposition must be served on the Applicant or the Applicant’s Attorney, with an affidavit or certificate of such service being filed with the Water Court, as prescribed by Rule 5, C.R.C.P.
