11CW22 ROUTT COUNTY; Application for Findings of Reasonable Diligence and/or to Make Water Rights Absolute. Applicant: Mike Luark. Please direct all correspondence to: SHERRY A. CALOIA, LLC, 1204 Grand Ave. Glenwood Springs, CO 81601, (970) 945-6067, firstname.lastname@example.org; Name of Structure: Sheep Corral Pond Enlargement; Location: in the NW ¼ SW ¼ of Section 9, Township 1 South, Range 85 West of the 6th P.M. approximately 1900 from the S section line and 450 feet from the W section line. Source: Springs Seeps and runoff tributary to Sunnyside Corral which is tributary to the Colorado River. Decree: February 28, 2005 in Case No. 03CW260 by the District Court in and for Water Division No. 5. Appropriation Date: November 1, 2001. Date applied to beneficial use: July 2008 by enlargement of Sheep Corral Pond by the additional 20 a.f. decreed to this Enlargement, and use of such water for all purposes. Amount: 20 acre-feet, conditional with right to refill and to continuously fill, conditional. Use: Piscatorial, aesthetic, recreational, and stockwater uses. If off-channel reservoirs, name and capacity of ditch or ditches used to fill reservoirs, and legal description of each point of diversion: Springs and runoff tributary to Sunnyside Corral at the rate of 1 c.f.s. Appropriation was initiated by: Field inspection, preliminary design of an enlarged pond, development of fishing opportunities for property and formulation of intent to divert and apply water to beneficial use. Dam length: 250 feet. Dam height:10 feet – max. Total volume: 24 a.f., conditional. Active storage: 14 a.f. Dead storage: 10 a.f. Surface area: 3acres (total for original and enlargement). Remarks: The Sheep Corral Pond was originally adjudicated in Case No. 92CW218 for 1.7 acre feet, absolute. The enlargement of the Sheep Corral Pond will be in areas that have been historically inundated with water naturally. Owner of land upon which pond is located: Applicant. The Application contains a detailed outline of what has been done toward completion of the appropriation and application of water to a beneficial use as conditionally decreed, including expenditures. YOU ARE HEREBY NOTIFIED THAT YOU HAVE until the last day of APRIL 2011 to file with the Water Clerk a verified Statement of Opposition setting forth facts as to why this application should not be granted or why it should be granted in part or on certain conditions. A copy of such statement of opposition must also be served upon the applicant or the applicant’s attorney and an affidavit or certificate of such service shall be filed with the Water Clerk, as prescribed by Rule 5, CRCP.
