Officer allegedly assaulted after traffic stop

Gary E. Salazar

— Two Oak Creek women allegedly assaulted an Oak Creek police officer during a traffic stop Sunday night.

Jane Wanda Plocinski and Rachele Marie Salazar face felony assault charges for allegedly kicking and punching Officer David Lee Miller Jr. during a traffic stop on Main Street at about 10:24 p.m.

Both women appeared in Routt County Court Monday afternoon. Judge James Garrecht set the bond for each woman at $5,000.

Both women are scheduled to return to court at 1 p.m. Wednesday.

During the court proceeding, Plocinski said she fears Miller and does not want any contact with him.

“I’m afraid of the officer,” Plocinski said.

According to court records, Miller had to take both women to the ground because they resisted arrest.

Miller stopped the vehicle Plocinski was allegedly driving because it was traveling without headlights, records show.

Miller requested Plocinski perform roadside tests for alcohol, but the woman allegedly refused. During the stop, Plocinski, 46, was being “uncooperative” and “verbally abusive,” which prompted the officer to request another officer come to the scene, records show.

As Miller was waiting for another officer to arrive, Plocinski allegedly got out of the vehicle and started to walk away from the scene, records show.

Miller went after Plocinski and attempted to stop her from walking away, records show.

At this time, Salazar, 37, allegedly got out of the vehicle and walked up behind Miller, who was trying to hold Plocinski, records show.

Miller pushed Salazar away and was forced to take Plocinski to the ground because the woman was allegedly punching and kicking him, records show.

At this time, two volunteer firefighters, Tony Morgan and Kelly Lipsie, came to the officer’s aid. The two firefighters held Salazar back while Miller arrested Plocinski, records show.

Salazar allegedly assaulted Lipsie by punching and kicking him, records show.

Once Plocinski was in custody, Miller went and got Salazar. Salazar allegedly punched and kicked Miller, which forced the officer to take the woman to the ground, records show.

Because of the incident, Plocinski faces charges of second-degree assault, a class four felony, and resisting arrest and drunken driving, which are misdemeanors.

Salazar faces two counts of second-degree assault, resisting arrest and obstructing a peace officer.
