Application for Surface Water Rights. First Claim for Water Right: Elk River Ranch Spring No. 1, located in the NE1/4 NW1/4 of Section 36, Township 8 North, Range 86 West of the 6th P.M., at a point 555 feet south from the North line and 2,184 feet east from the West line of said Section 36. The location is depicted on Exhibit A on file with the Water Court. Source: George’s Gulch, tributary to Salt Creek, tributary to the Elk River, tributary to the Yampa River. Date of appropriation: November 1, 2006. How appropriation was initiated: Applicant purchased the property and began watering livestock from the spring. Date water applied to beneficial use: 11/1/2006. Amount: 15 g.p.m., absolute. Uses: Stock watering and wildlife watering. Second Claim for Water Right: Elk River Ranch Spring No. 2, located in the NW1/4 NW1/4 of Section 31, Township 8 North, Range 85 West of the 6th P.M., at a point 1,002 feet south from the North line and 358 feet east from the West line of said Section 31. The location is depicted on Exhibit B on file with the Water Court. Source: George’s Gulch, tributary to Salt Creek, tributary to the Elk River, tributary to the Yampa River. Date of appropriation: 11/1/2006. How appropriation was initiated: Applicant purchased the property and began watering livestock from the spring. Date water applied to beneficial use: 11/1/2006. Amount: 5 g.p.m., absolute; 10 g.p.m., conditional. Uses: Stock watering and wildlife watering. Third Claim for Water Right: Elk River Ranch Spring No. 3, located in the NW1/4 NE1/4 of Section 31, Township 8 North, Range 85 West of the 6th P.M., at a point 928 feet south from the North line and 1,455 feet west from the East line of said Section 31. The location is depicted on Exhibit C on file with the Water Court. Source: George’s Gulch, tributary to Salt Creek, tributary to the Elk River, tributary to the Yampa River. Date of appropriation: 11/1/2006. How appropriation was initiated: Applicant purchased the property and began watering livestock from the spring. Date water applied to beneficial use: 11/1/2006. Amount: 15 g.p.m., absolute. Uses: Stock watering and wildlife watering. Name and address of owner of land upon which the Elk River Ranch Spring Nos. 1, 2 and 3 are located: Applicant. Remarks: The Elk River Ranch Spring Nos. 1, 2 and 3 are natural springs, on which no improvements have been made. Water flowing from the springs collects in the draws where the springs are located and are used to water stock and wildlife.



You are hereby notified that you will have until the last day of FEBRUARY, 2011 to file with the Water Court a Verified Statement of Opposition, setting forth facts as to why a certain Application should not be granted or why it should be granted only in part or on certain conditions. A copy of such Statement of Opposition must be served on the Applicant or the Applicant’s Attorney, with an affidavit or certificate of such service being filed with the Water Court, as prescribed by Rule 5, C.R.C.P. The filing fee for the Statement of Opposition is $158.00, and should be sent to the Clerk of the Water Court, Division 6, P.O. Box 773117, Steamboat Springs, CO 80477.
