Wall said he wouldn't resign, he wants to continue what he's accomplished. What's he referring to?

It's my understanding that the roadside tests are used to indicate if a breathalizer test is warranted. If Wall didn't take the roadside test (or any other test) how could anyone determine if his BAC exceeded the legal limit?
Apparentlly both Mackey & Elderidge inadvertently contradicted themselves. I would say from the paper's article neither had conclusive testimony. I would also guess that they were called to the scene to get Wall home, not determine if he was intoxicated. I believe that's why they can only offer an opinion.

They were both under oath, I believe they both stated their true opinions. They just had different opinions.

I think the answer to the question “WHY (wasn't he arrested?)” is that the CSP provided a “?professional?” extension of goodwill to the Sheriff so that his own subordinates wouldn't have to endure the discomfort of booking him in his own jail and he wouldn't have endure the embarrassment of a Barney Fife role. The order likely came from CSP HQ rather than a decision made at the scene.

He'll walk (literally: can't drive). Without the BAC results there is not “proof beyond a reasonable doubt.”

Why has he wasted the taxpayers money? He knew he was borderline and didn't want to chance the results. He knew by refusing the breathalizer he'd likely lose the license but there'd be no evidence to find him guilty of the DUI or weapons charges. Clever.

Deputy drove him home, not hauled into jail. Why did he receive that special treatment?
